family could soon be out of prison. a california parole board has approved a request from bruce davis. he's serving a life sentence for the 1969 murders of music teacher gary hindman and stuntman shorty shay. >> the parole board says it has 120 days to review this recommendation and then it's up to the california governor, jerry brown, to decide if it stands. davis was granted parole in 2010 but that decision was overturned by then governor arnold schwarzenegger. if he goes free, davis would be the second convicted manson family killer to be freed on parole. steve grogan who was also convicted in the murder of the stuntman shorty shay, was released on parole in the mid-1980s. the prosecutor who sent the manson family to prison says davis should stay behind bars. manson himself was denied parole for the 12th time. he will not be eligible for parole for 15 years. by then, he will be 92 years old. arnold schwarzenegger said it was because of the heinous crimes. this was something that gripped the country and still is a part of kind of our psyche today. the parole board, though, saying he has

prices in california hitting an all time high. aaa reporting that a cost for gallon of regular gas jumped 12 cents overnight bringing the total 4.61, that 80 cents higher than the national average. is there any relief in sight. dominic is financial advisor joins us. hopefully, there is good news. first of all, why the high prices? what is causing this? >> again we had a similar problem. there is short term problems that are kind of unique to california. they had another refinery outage earlier in the week and that caused really shortages in the summer blend they need. earlier firings in august. the sum of perfect storm incidents have created a short term problem. hopefully we'll see relief in coming weeks. >> heather: there is simple explanation and real ex pla nation? >> the real explanation. on the average californians pay dollar per gallon 25% more than the national average. a lot of it has to do with regulation and taxation. they have created a lot of their own problems. on the average, californians pay over 50 cents a gallon in tax, compared 15 cents to new jersey, for example. they

. >> california gas prices rising to a new high record. the average hitting $4.67 yesterday. the national average is $3.81. a whole lot are selling gas for a lot higher prices. like this one in san diego selling for almost $6 as gallon for premium gasoline. california senator demanding a federal investigation into whether or not gas companies are illegally coordinating this hike in prices. by the way $0.67 of every gallon of gasoline in california goes to state and federal taxes that's among the highest in the nation. he will put his life on the line as he attempts a world record jump. he will sky dive from a capsule 33 miles above the planet's surface. he will smash through the sound barrier on the way top speed 690 miles an hour. for an idea of how high this is. consider mt. everest rises 29,000 feet. commercial jets cruise around at 39,000 feet. this guy will be jumping from 120,000 feet. >> really? >> yup. >> that's your 5@5:00. >>> couple minutes after the hour we are exactly 4 weeks away from the presidential election mitt romney delivering a major foreign policy address yesterday making th
